Staying in Korea

Applying for a Foreigner Registration Card for
Your Foreigner Spouse

A foreigner who married to a Korean citizen and entered Korea with a resident
visa (F-2 and F-2-1) must apply for an extension of stay and a foreigner
registration card before the visa expires. If you do not obtain approval for an
extension of sty within 90 days of entering the country, you will be categorized
as an illegal immigrant and a fine will be imposed. To apply, visit the nearest
immigration office or branch office and subit the required documentation.

Documents to Submit to Apply for Foreigner Registration and an Extension
of Stay

1. Foreigner Registration Application Form + Extension of Stay Application
Form (the same form)
2. Passport and two 3.5cm x 4.5 size color photos
3. Proof of your marital status with your Korean spouse
4. A copy of your Korean spouse's resident registration
(issued within the past 3 months)
5. Proof of identity Signed by a Witness
6. Fee: 30,000 won

Who is qualified as a witness to your identity?
In the past, only the Korean spouse or his/her relatives could be a witness.
However, as of March 1, 2005, the qualification of the witness was expanded to
include any third party who has the capacity to guarantee in order to protect the
privacy and human rights of foreigners who are married to Korean citizens.

Getting a Job or Moving While Staying in Korea

Foreigners who are married to a Korean citizen (F-2-1) are allowed to seek
employment freely within the perimeter of their area of abode. In case you find a job
outside your area of abode, you can apply for a change of area of abode to work.
You also need to apply for a change of area of abode in case you move to another
area. Bring your passport and your foreigner registration card to the immigration
office that has jurisdiction over the area you are moving into and apply for a change.
If you do not report the change of your area of abode within 14 days of moving, a
fine will be imposed.

Immigration Status in Case of a Divorce or the
Death of Your Spouse

In case you were legally married to a Korean citizen but your spouse dies, you
can continue to stay in Korea if you wish. If you divorce from your spouse, your
immigration status will be decided based on who has provided the reason for
the divorce and whether there are children from the marriage. You must meet
the following requirement in order to continue to stay in Korea with an F-2 status
after your divorce.

You can continue to stay in Korea after your divorce if :
1. The court rules that it was your Korean spouse who provided the reason for
the divorce; or if you provide evidence showing that the reason for the failure
of your marriage is ascribed to your Korean spouse.
2. You have the legal custody over the children born between you and your
Korean spouse.
3. You have the visitation rights to the children born between you and your
Korean spouse.

In case you lived together without getting legally married :
According to the Nationality Act, only foreigners who have completed the
“legally valid marriage proceedings” with their Korean spouses are allowed
to apply for simplified naturalization procedures through marriage. Therefore,
foreigners who simply live together with a Korean citizen may not apply for
naturalization. Foreigners who are simply living together are entitled to apply
for general naturalization, instead of simplified naturalization, and are allowed
to apply for naturalization only after 5 consecutive years of living in Korea
under the Nationality Act.

How to Respond to Human Rights Violations

At factories, people often use bad languages. Sometimes they are not
particularly angry but curse out of habit. It is only natural that you get angry
when you hear band languages or curse words. When that happens, try not to
start a fight. Instead ask the person to stop. If the situation is likely to escalate

1) The 1st reunion of families separated

Status of the 1st visiting group

The Korean Government & The Korean National Red Cross Society(KNRC) prepared for selecting of the visiting group since exchange of families separated was reached an agreement around 15 August through South & North Korea Joint Declaration executed on 15th June. First of all, the selected committee was composed of 12 persons who are chose from the experts of the body related with families separated, the government, the press, the academic world, the women world, and the legal world on 22 June, 2000. and the secretary general of KNRC was appointed as a chairman of a committee  




Since an exchange schedule of visiting group was confirmed through the 1st Red Cross Conference, The selection committee was composed and it selected the 1st candidates, 400 persons in public by a computer on the basis of age, family relationship, application in the past with the principle of justice, clearness, and trust. The dead or unhealthy of them were sorted out and finally 200 candidates were selected for the inquiry of living and dying or address to North Korea.
The list of 200 candidates was delivered through South and North Liaison on 16 July. South Korean opened to the public the list of 200 candidates given by North Korea and 198 persons of them were verified in a short period. Also, 138 out of 200 persons were confirmed in North Korea. The final visiting group of 100 was fixed on the basis of age and family relationship by the result from North Korea. After that, South and North Korea exchanged the list of visiting group on 8 Aug., 2000.

Exchanging schedule of the 2nd visiting group was confirmed in the 2nd Red Cross Conference held during 2~4 Nov. 2000. A government opened the selection committee and decided the standard of selection for the 2nd visiting group exchange.The aged, who are more than 70 years, are prior to all others for selecting of 2nd visiting group.
South Korea confirmed 195 out of 200 persons who North Korea inquired and North Korea verified 162 out of 200 persons. After that, South and North Korea exchanged the list of the final visiting group, 100 persons on 18 Nov.

Industrial Accidents and Compensation

The Industrial Accident Compensation Insurance Act provides for treatment
and compensation for employees. Getting treatment and compensation for an
industrial accident often requires complicated procedures and may take a long time
depending on the type of the accident and the extent of the injury. In addition, there
are many different kinds of documents you need to submit to the Korea Workers’
Compensation and Welfare Service (KWCWS). If you are unable to obtain sufficient
information either from your employer or the hospital or you don’t understand the
information provided, you should go to a counseling organization and ask for help.

Below is what you should know about industrial accidents.

• In general, the employer applies for industrial accident compensation. If your
employer does not do it for you, you or your family memeber can go to the KWCWS
and apply for compensation, or go to a counseling organization and ask for help.
• In case of an accident, the initial treatment is critical. Be sure to be seen and
treated by a specialist. Particularly in case of an finger amputation accident, you
must demand to be taken to a hospital that can perform a finger replantation
surgery with the cutoff finger(s) within 24 hours of the accident.
• If the injury happens while at work, you can still receive compensation even
if it is a result of your mistake.
• You can receive your sick leave benefits and disability compensation only
through your own banck account. Therefore, if you are injured in an industrial
accident and begin to receive treatment, make a bank account immediately
and keep the bankbook in a safe place.
• While an employee is on a sick leave due to an industrial accident, the employer
may not terminate his/her employment or force him/her to leave the country.
Some foreign employees are forced to leave the country while recuperating from
an injury due to an industrial accident because they are not familiar with the law.
In some cases, an employee dies from an industrial accident and the family does
not receive any compensation because they are not familiar with the Korean
situation. In order to avoid such an unfortunate situation, you should talk to a
counseling assistance organization to find out about your rights.

▶ Details of Compensation
• Medical Costs Assistance
- Provides 70% of your wage during the treatment period.
- Helps pay for a caregiver in case you need one.
- Provides disability compensation in case your state of incapacity continues
after the treatment is complete.
- Provides assistance in case you have a relapse after the treatment is
complete.
- Pays family compensation and funeral expenses to the surviving family
members in case of a death.
- Provides professional development training and skills training in case you are
given a disability rating between 1 and 14, your visa is valid for another year
or longer, and you have the Korean language skills.
• Occupational Diseases
- You are entitled to the industrial accident insurance benefits and receive
treatment and compensation if it is officially recognized that your condition
has been caused by your work.

▶ Rehabilitation Training
- Anyone who becomes disabled by an industrial accident, is given a disability
rating between 1 and 14 as a result and 50 years of age is entitled to
professional development and skills training at the Rehabilitation Training
Center of the Korea Workers’ Compensation and Welfare Service (KWCWS).
While training, you are provided with living accomodation, meals and a
certain amount of training pay. In case you participate in a job training
program at a private training institution, the KWCWS may pay the costs. If
you are a victim of an industrial accident and became disabled as a result,
learn more about this and take advantage of it.

Safe Working Environment

▶ Basic Safety Rules
To prevent accidents at work, it is very important to: frequently tidy up and
clean your work area and the aisles and passageways in the vicinity to ensure
they are clear of any obstacles. Check often to make sure there are no slippery
spots. Below are the safety rules that must be observed at all work sites at all
times.

• Hazardous materials must be sorted by type and placed in the specified
containers and specified locations.
• While working, be sure to put on your work uniform; do not smoke, eat or drink
while remaining at the work site.
• Be sure to put on the safety gears, including the safety helmet and safety boots.
• Put on your safety gloves instead of cotton gloves when you work on a rotating
machine.
• Put on your safety goggles when you peform a job that may cause fine dust
particles or residues to fly, such as cutting or grinding.
• Put on your safety (gas) mask when you perform a job that involves handling
organic solvents, such as a detergent or glue.
• Familiarize yourself with the locations of the emergency exits.
• Know where the first aid kit and the fire extinguishers are located.
• Familiarize yourself with the meaning of each safety signs and message.
• Wash your hands thoroughly before you eat.

Social Security System

How It Works

There are four types of social indurance programs that apply to all employees:
health insurance, industrial accident insurance, employment insurance and
national pension plan. Foreign employees can enjoy the same benefits.

▶ Health Insurance
Health insurance helps you pay for your medical
costs incurred when you visit hospitals or clinics. The
premium is shared equally by the employer and the
employee.

▶ Industrial Accident Insurance
Industrial accident insurance helps you pay for the
treatment and provides compensation in case you get
injured at work or develop an illness resulting from
your work. The premium is paid by the employer.







▶ Employment Insurance
Employment insurance provides you with unemployment benefits in case you
are temporarily out of work until you find a new employment. The premium
is equally shared by the employer and the employee. All Employment Permit
Program employees are obligated to sign up for the employment insurance
under law. Therefore, just like Koreans, if you work for an employer for 180 days
or longer and then lose your job, you are entitled to apply for unemployment
benefits at the Employment Stability Center. However, because of the opinion
that foreign workers receive fewer benefits from signing up for the insurance
than Koreans do, it is no longer obligatory to sign up.

▶ National Pension Plan
Under the plan, employees contributes a certain amount of premium until they
are 59 years old and start receiving pension when they turn to 60. The premium
is deducted from the employee’s monthly wage. Not all foreign employees are
obligated to join. Among the countries under the Employment Permit Program,
9 countries (Mongolia, Sri Lanka, Indonesia, Uzbekistan, China, Kazakhstan,
Thailand, the Philippines and Kyrkyzstan) are obligated to join the pension plan
under the “Convention between Republic of Korea and the Countries of Origin
of Foreign Employees.” And employees from four of these countries (Sri Lanka,
Indonesia, Kazakhstan and Thailand [under certain conditions]) can get their
contribution back on leaving Korea.
There is an argument that applying the national pension plan that provides
benefits for retirees aged 60 years or older to foreign employees who should
return to their countries after three years of employment is not appropriate. The
decision whether to continue to apply is expected to be made shortly. However,
until then, you don‘t have any choice but to pay the premium.
